These terms govern all transactions across all services offered on Smpanel.in, including but not limited to Instagram followers, reels engagement, YouTube views, watch time fulfillment, Telegram channel subscribers, TikTok metrics, Facebook page likes, and Twitter/X impressions.

2. Account Registration, Authenticity & Security

To utilize our ordering dashboard or API, you must complete the registration process. You represent and warrant that:

• You are at least 18 years of age and possess full legal capacity to enter into binding agreements under the Indian Contract Act 1872.
• All registration details (username, active email address) submitted are accurate, current, and verifiable.
• You will maintain the strict confidentiality of your account credentials, passwords, and assigned API keys. You are solely responsible for all orders and activities that occur under your account.
• You will immediately notify Smpanel.in technical support if you suspect unauthorized access or security compromises involving your account.

3. Zero-Password Protocol & Customer Safety Architecture

Smpanel.in maintains a strict Zero-Password Security Standard. Under no circumstance will Smpanel.in staff, automated bots, or communication channels ever ask for your social media account passwords, SMS OTPs, 2FA recovery keys, or personal credentials.

All promotional services are fulfilled strictly using publicly available target URLs (profile links, video links, channel usernames). Users are strictly advised to report any individual claiming to represent Smpanel.in who requests access to private accounts.

4. Prohibited Content, Services & Conduct

Users agree not to submit orders or utilize Smpanel.in infrastructure to promote, distribute, or amplify any of the following prohibited categories:

• Content that promotes religious disharmony, communal violence, hate speech, terrorism, or unlawful insurgent activities.
• Defamatory, extortionist, stalking, or harassing content targeting private individuals or public figures.
• Unlicensed pharmaceutical sales, narcotics, illicit substances, or prescription drug promotions.
• Financial fraud schemes, phishing portals, ponzi operations, or deceptive investment solicitations.
• Sexually explicit, non-consensual imagery, or child sexual exploitation material (CSAM)—which will trigger immediate account freezing and mandatory reporting to Indian law enforcement authorities.

Smpanel.in reserves the absolute right to cancel orders, freeze account balances, and terminate accounts involved in prohibited activities without notice or financial compensation.

5. Compliance with Third-Party Platform Policies

You explicitly recognize that Smpanel.in is an independent third-party technology provider and is in no way affiliated, endorsed, or partnered with Meta Platforms Inc. (Instagram, Facebook, WhatsApp), Alphabet Inc. (YouTube, Google), ByteDance (TikTok), Telegram Messenger Inc., or X Corp. (Twitter).

Using social media marketing panels involves inherent risks under the terms of service of third-party platforms. Social networks periodically update algorithms, perform bot sweeps, and implement promotional restrictions.

By purchasing services on Smpanel.in, you acknowledge that Smpanel.in cannot guarantee that third-party platforms will not adjust counts or flag profiles. Smpanel.in accepts no financial or legal liability for any adverse actions taken against your accounts by third-party platforms, including shadowbans, account suspensions, or algorithmic de-ranking.

6. Financial Terms, Pricing & Domestic Payments

All service transactions and account balance calculations on Smpanel.in are denominated in Indian Rupees (INR ₹):

• Payment Gateways: Deposits may be completed using authorized Indian payment methods including Unified Payments Interface (UPI via PhonePe, Google Pay, Paytm, BHIM), direct Paytm wallet, and domestic Net Banking.
• Instant Top-Up Verification: Deposits are confirmed programmatically via gateway webhooks or 12-digit UTR verification.
• Non-Refundable Wallet Balances: Deposited funds are converted to digital platform credits and cannot be refunded back to personal bank accounts, except under specific failure conditions covered in our Refund Policy.
• Price Adjustments: Smpanel.in reserves the right to modify service rates at any time based on underlying server costs and provider availability. Active orders will always be completed at the rate locked during submission.

7. Order Execution, Delivery Timelines & Refills

When submitting an order, you agree to comply with the operational guidelines:

• Link Accuracy: You are solely responsible for ensuring the target link format is correct and corresponds to the exact platform selected. Incorrect links will result in order failure or misdelivery.
• Public Account Requirement: All target profiles or posts must remain Public from order placement until full delivery completion. Setting an account to Private during active processing invalidates delivery guarantees.
• Delivery Speeds as Estimates: Stated start times (e.g., 0-15 mins) and completion speeds (e.g., 5,000/day) are operational estimates reflecting historical averages, not guaranteed contractual deadlines. Speeds can fluctuate during major social platform maintenance.
• Refill Warranties: Services explicitly labeled with refill protection entitle users to automated top-ups if drop-offs occur within the stated warranty window. Refill requests must be submitted through the dashboard refill button.

8. Reseller Responsibilities & REST API Standards

Users who utilize our REST API v2 or act as third-party resellers agree to the following additional covenants:

• You agree to represent service descriptions, delivery speeds, and potential drop rates honestly to your end customers.
• You agree not to impersonate Smpanel.in, claim official affiliation, or use Smpanel.in brand marks in deceptive marketing.
• You will maintain reasonable API polling intervals. Excessive or malicious endpoint bombardment exceeding 100 requests per minute may trigger automated rate-limiting or API key revocation.
• You accept full customer support and financial liability toward your downstream buyers. Smpanel.in does not interact with your end clients directly.

9. Disclaimer of Warranties & Limitation of Liability

Smpanel.in services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a specific marketing purpose, or continuous uninterrupted uptime.

In no event shall Smpanel.in, its founders, operators, employees, or technical contractors be liable for any indirect, incidental, punitive, special, or consequential damages arising out of your use or inability to use the platform.

The aggregate financial liability of Smpanel.in for any claim arising out of your usage shall under no circumstances exceed the lesser of: (1) The total rupee amount paid by you for the specific disputed order; or (2) ₹1,000 INR.

10. Indemnification

You agree to defend, indemnify, and hold harmless Smpanel.in, its directors, employees, and technical affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from: (1) Your breach of these Terms; (2) Content or URLs submitted by you for promotion; or (3) Your violation of any applicable law or rights of a third party.

11. Governing Law & Dispute Jurisdiction

These Terms of Service and any dispute arising from your interaction with Smpanel.in shall be governed by and construed in accordance with the laws of the Republic of India, specifically under the provisions of the Information Technology Act 2000 and the Indian Contract Act 1872.

Both parties agree to submit to the exclusive territorial jurisdiction of the competent civil courts situated in India for the resolution of any legal proceedings or arbitration.

12. Amendments to Terms

Smpanel.in reserves the discretionary right to update, modify, or replace any portion of these Terms. Revised versions will be published on this page with an updated revision date. Continued utilization of Smpanel.in following any published amendments constitutes legal acceptance of the modified Terms.
